Who is responsible for data collection on this website?

Data processing on this website is carried out by the website operator. You can find their contact details in the section “Information on the responsible party” in this privacy policy.

How do I collect your data?

Your data is collected firstly by you providing it to me. This may be data that you enter in a contact form, for example.

Other data is collected automatically or with your consent when you visit the website by my IT systems. This is primarily technical data (e.g. internet browser, operating system or time of page access). This data is collected automatically as soon as you enter this website.

What do I use your data for?

Some of the data is collected to ensure the error-free provision of the website. Other data may be used to analyse your user behaviour.

You also have the right, under certain circumstances, to request the restriction of the processing of your personal data. Furthermore, you have the right to lodge a complaint with the competent supervisory authority.

You can contact me at any time regarding this and other questions on the subject of data protection.

External hosting

This website is hosted externally. The personal data collected on this website is stored on the servers of the host. This may include IP addresses, contact requests, meta and communication data, contract data, contact details, names, website accesses and other data generated via a website.

The external hosting is carried out for the purpose of fulfilling contracts with my potential and existing customers (Art. 6 para. 1 lit. b DSGVO) and in the interest of the secure, fast and efficient provision of my online offering by a professional provider (Art. 6 para. 1 lit. f DSGVO). If a corresponding consent has been requested, the processing is carried out exclusively on the basis of Art. 6 para. 1 lit. a DSGVO and § 25 para. 1 TDDDG, insofar as the consent includes the storage of cookies or access to information on the user’s terminal device (e.g. device fingerprinting) within the meaning of the TDDDG. The consent can be revoked at any time.

My host will only process your data to the extent necessary to fulfil its service obligations and will follow my instructions with regard to this data.

3. GENERAL INFORMATION AND MANDATORY DISCLOSURES

Data protection

The operator of these pages takes the protection of your personal data very seriously. I treat your personal data confidentially and in accordance with the statutory data protection regulations as well as this privacy policy.

When you use this website, various personal data is collected. Personal data is data with which you can be personally identified. This privacy policy explains what data I collect and what I use it for. It also explains how and for what purpose this is done.

I would like to point out that data transmission over the Internet (e.g. when communicating by e-mail) may have security gaps. Complete protection of data against access by third parties is not possible.

Information on the responsible party

The responsible party for data processing on this website is:

Maximilian Lamm Schäftlarnstraße 93 81371 München

Telephone: +49 176 69262318 E-Mail: info[at]maxlamm.de

The responsible party is the natural or legal person who alone or jointly with others determines the purposes and means of the processing of personal data (e.g. names, e-mail addresses, etc.).

Storage period

Unless a more specific storage period has been stated within this privacy policy, your personal data will remain with me until the purpose for data processing no longer applies. If you assert a justified request for deletion or revoke your consent to data processing, your data will be deleted, unless I have other legally permissible reasons for storing your personal data (e.g. tax or commercial law retention periods); in the latter case, deletion will take place after these reasons cease to apply.

If you have consented to data processing, I process your personal data on the basis of Art. 6 para. 1 lit. a DSGVO or Art. 9 para. 2 lit. a DSGVO, if special categories of data are processed pursuant to Art. 9 para. 1 DSGVO. In the case of express consent to the transfer of personal data to third countries, the data processing is also carried out on the basis of Art. 49 para. 1 lit. a DSGVO. If you have consented to the storage of cookies or to the access to information on your terminal device (e.g. via device fingerprinting), the data processing is additionally carried out on the basis of § 25 para. 1 TDDDG. The consent can be revoked at any time. If your data is required for the performance of a contract or for the implementation of pre-contractual measures, I process your data on the basis of Art. 6 para. 1 lit. b DSGVO. Furthermore, I process your data if this is necessary for the fulfilment of a legal obligation on the basis of Art. 6 para. 1 lit. c DSGVO. Data processing may also be carried out on the basis of my legitimate interest pursuant to Art. 6 para. 1 lit. f DSGVO. Information on the relevant legal bases in each individual case is provided in the following paragraphs of this privacy policy.

Information on data transfer to countries with inadequate data protection standards and the transfer to US companies that are not DPF-certified

I use, among other things, tools from companies based in countries with inadequate data protection standards as well as US tools whose providers are not certified under the EU-US Data Privacy Framework (DPF). When these tools are active, your personal data may be transferred to and processed in these countries. I would like to point out that no level of data protection comparable to that in the EU can be guaranteed in countries with inadequate data protection standards.

I would like to point out that the USA, as a safe third country, generally has a level of data protection comparable to that of the EU. A data transfer to the USA is therefore permissible if the recipient has a certification under the “EU-US Data Privacy Framework” (DPF) or has suitable additional guarantees. Information on transfers to third countries, including the data recipients, can be found in this privacy policy.

Recipients of personal data

In the course of my business activities, I work with various external parties. In some cases, the transmission of personal data to these external parties is also necessary. I only pass on personal data to external parties if this is necessary in the context of the fulfilment of a contract, if I am legally obliged to do so (e.g. passing on data to tax authorities), if I have a legitimate interest pursuant to Art. 6 para. 1 lit. f DSGVO in the transfer, or if another legal basis permits the data transfer. When using processors, I only pass on personal data of my customers on the basis of a valid data processing agreement. In the case of joint processing, a joint processing agreement is concluded.

Many data processing operations are only possible with your express consent. You can revoke any consent you have already given at any time. The lawfulness of the data processing carried out until the revocation remains unaffected by the revocation.

Right to object to data collection in special cases and to direct marketing (Art. 21 DSGVO)

If the data processing is based on Art. 6 para. 1 lit. e or f DSGVO, you have the right at any time to object to the processing of your personal data for reasons arising from your particular situation; this also applies to profiling based on these provisions. The respective legal basis on which processing is based can be found in this privacy policy. If you object, I will no longer process your personal data concerned unless I can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims (objection pursuant to Art. 21 para. 1 DSGVO).

If your personal data is processed for the purpose of direct marketing, you have the right to object at any time to the processing of your personal data for the purpose of such marketing; this also applies to profiling insofar as it is related to such direct marketing. If you object, your personal data will subsequently no longer be used for the purpose of direct marketing (objection pursuant to Art. 21 para. 2 DSGVO).

Right to lodge a complaint with the competent supervisory authority

In the event of violations of the DSGVO, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, their place of work or the place of the alleged violation. The right to lodge a complaint is without prejudice to any other administrative or judicial remedy.

Right to data portability

You have the right to have data that I process automatically on the basis of your consent or in fulfilment of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done insofar as it is technically feasible.

Access, correction and deletion

Within the scope of the applicable statutory provisions, you have the right at any time to free information about your stored personal data, its origin and recipients and the purpose of data processing and, if applicable, a right to correction or deletion of this data. You can contact me at any time regarding this and other questions on the subject of personal data.

Right to restriction of processing

You have the right to request the restriction of the processing of your personal data. You can contact me at any time for this purpose. The right to restriction of processing exists in the following cases:

If you dispute the accuracy of your personal data stored by me, I generally need time to verify this. For the duration of the verification, you have the right to request the restriction of the processing of your personal data. If the processing of your personal data has been/is unlawful, you can request the restriction of data processing instead of deletion. If I no longer need your personal data, but you need it for the exercise, defence or assertion of legal claims, you have the right to request the restriction of the processing of your personal data instead of deletion. If you have lodged an objection pursuant to Art. 21 para. 1 DSGVO, a balance must be struck between your interests and mine. As long as it has not yet been determined whose interests prevail, you have the right to request the restriction of the processing of your personal data. If you have restricted the processing of your personal data, this data may – apart from its storage – only be processed with your consent or for the assertion, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the European Union or a Member State.

SSL or TLS encryption

This site uses SSL or TLS encryption for security reasons and to protect the transmission of confidential content, such as orders or enquiries that you send to me as the site operator. You can recognise an encrypted connection by the fact that the address line of the browser changes from “http://” to “https://” and by the lock symbol in your browser line.

If SSL or TLS encryption is activated, the data you transmit to me cannot be read by third parties.

Objection to promotional e-mails

The use of contact data published within the scope of the legal notice obligation for the purpose of sending unsolicited advertising and information materials is hereby objected to. I expressly reserve the right to take legal action in the event of the unsolicited sending of advertising information, such as spam e-mails.

4. DATA COLLECTION ON THIS WEBSITE

Cookies

My websites use so-called “cookies”. Cookies are small data packets and do not cause any damage to your terminal device. They are stored on your terminal device either temporarily for the duration of a session (session cookies) or permanently (permanent cookies). Session cookies are automatically deleted after your visit ends. Permanent cookies remain stored on your terminal device until you delete them yourself or they are automatically deleted by your web browser.

Cookies can originate from me (first-party cookies) or from third-party companies (so-called third-party cookies). Third-party cookies enable the integration of certain services of third-party companies within websites (e.g. cookies for the processing of payment services).

Cookies have various functions. Many cookies are technically necessary, as certain website functions would not work without them (e.g. the display of videos). Other cookies can be used to evaluate user behaviour or for advertising purposes.

Cookies that are required for the execution of the electronic communication process, for the provision of certain functions you have requested or for the optimisation of the website (e.g. cookies for measuring web audience) (necessary cookies) are stored on the basis of Art. 6 para. 1 lit. f DSGVO, unless another legal basis is specified. I have a legitimate interest in the storage of necessary cookies for the technically error-free and optimised provision of my services. If consent to the storage of cookies and comparable recognition technologies has been requested, the processing is carried out exclusively on the basis of this consent (Art. 6 para. 1 lit. a DSGVO and § 25 para. 1 TDDDG); the consent can be revoked at any time.

You can set your browser to inform you about the setting of cookies and only allow cookies on a case-by-case basis, exclude the acceptance of cookies for certain cases or in general, and activate the automatic deletion of cookies when the browser is closed. If cookies are deactivated, the functionality of this website may be limited.

You can find out which cookies and services are used on this website from this privacy policy.

Contact form

If you send me enquiries via the contact form, your details from the enquiry form, including the contact details you provided there, will be stored by me for the purpose of processing the enquiry and in case of follow-up questions. I will not pass on this data without your consent.

The processing of this data is carried out on the basis of Art. 6 para. 1 lit. b DSGVO, if your enquiry is related to the fulfilment of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on my legitimate interest in the effective processing of enquiries addressed to me (Art. 6 para. 1 lit. f DSGVO) or on your consent (Art. 6 para. 1 lit. a DSGVO) if this has been requested; the consent can be revoked at any time.

The data you enter in the contact form will remain with me until you request deletion, revoke your consent to storage or the purpose for data storage no longer applies (e.g. after the completion of your enquiry). Mandatory statutory provisions – in particular retention periods – remain unaffected.

The contact form is processed via a server-side PHP script hosted on the same server as the website (Uberspace). No data is transmitted to third-party providers.

Enquiry by e-mail, telephone or fax

If you contact me by e-mail, telephone or fax, your enquiry including all resulting personal data (name, enquiry) will be stored and processed by me for the purpose of processing your request.

The data sent by you to me via contact enquiries will remain with me until you request deletion, revoke your consent to storage or the purpose for data storage no longer applies (e.g. after the completion of your request). Mandatory statutory provisions – in particular statutory retention periods – remain unaffected.

5. ANALYTICS AND ADVERTISING

Umami

This website uses the analytics tool Umami. Umami is a privacy-friendly open-source web analytics platform.

Umami does not collect any personal data and does not use cookies. The analysis is based on anonymised, aggregated data. IP addresses are not stored and no tracking of individual users takes place. Only general usage statistics such as page views, dwell time, referrers and device types used are collected.

Umami is hosted on my own server (Uberspace). No data is shared with third parties.

The use of this analytics tool is based on Art. 6 para. 1 lit. f DSGVO. I have a legitimate interest in the anonymised analysis of user behaviour in order to optimise my web offering. Since Umami does not collect any personal data and does not set cookies, consent pursuant to § 25 TDDDG is not required.

6. PLUGINS AND TOOLS

YouTube (with enhanced privacy mode)

This website embeds videos from the website YouTube. The operator of the website is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

I use YouTube in enhanced privacy mode. According to YouTube, this mode means that YouTube does not store any information about visitors to this website before they watch the video. The videos are embedded via the domain youtube-nocookie.com. When simply accessing a page with an embedded video, no tracking cookies are initially set by YouTube.

As soon as you start an embedded video by clicking on it, a connection to YouTube’s servers is established. This tells the YouTube server which of my pages you have visited. YouTube may also store various cookies on your terminal device or use comparable technologies for recognition (e.g. device fingerprinting). In this way, YouTube can receive information about visitors to this website. This information is used, among other things, to collect video statistics, improve user-friendliness and prevent fraud.

If you are logged into your YouTube account, you enable YouTube to assign your browsing behaviour directly to your personal profile. You can prevent this by logging out of your YouTube account.

The use of YouTube is in the interest of an appealing presentation of my online offerings. This constitutes a legitimate interest within the meaning of Art. 6 para. 1 lit. f DSGVO.

Further information on the handling of user data can be found in YouTube’s privacy policy at: https://policies.google.com/privacy?hl=de.

The company has a certification under the “EU-US Data Privacy Framework” (DPF). The DPF is an agreement between the European Union and the USA that is intended to ensure compliance with European data protection standards for data processing in the USA. Every company certified under the DPF undertakes to comply with these data protection standards. Further information on this can be obtained from the provider at the following link: https://www.dataprivacyframework.gov/s/participant-search/participant-detail?contact=true&id=a2zt000000001L5AAI&status=Active

Vimeo

This website uses plugins from the video portal Vimeo. The provider is Vimeo Inc., 555 West 18th Street, New York, New York 10011, USA.

When you visit one of my pages equipped with a Vimeo video, a connection to Vimeo’s servers is established. This tells the Vimeo server which of my pages you have visited. Vimeo also obtains your IP address. This also applies even if you are not logged into Vimeo or do not have a Vimeo account. The information collected by Vimeo is transmitted to Vimeo’s server in the USA.

If you are logged into your Vimeo account, you enable Vimeo to assign your browsing behaviour directly to your personal profile. You can prevent this by logging out of your Vimeo account.

Vimeo uses cookies or comparable recognition technologies (e.g. device fingerprinting) to recognise website visitors.

The use of Vimeo is in the interest of an appealing presentation of my online offerings. This constitutes a legitimate interest within the meaning of Art. 6 para. 1 lit. f DSGVO.

The data transfer to the USA is based on the Standard Contractual Clauses of the EU Commission and, according to Vimeo, on “legitimate business interests”. Details can be found here: https://vimeo.com/privacy.

Further information on the handling of user data can be found in Vimeo’s privacy policy at: https://vimeo.com/privacy.

Google Fonts (external)

This site uses so-called Google Fonts, which are provided by Google, for the uniform display of fonts. When you access a page, your browser loads the required fonts into its browser cache in order to display texts and fonts correctly.

For this purpose, the browser you are using must establish a connection to Google’s servers. This gives Google knowledge that this website has been accessed via your IP address. The use of Google Fonts is based on Art. 6 para. 1 lit. f DSGVO. I have a legitimate interest in the uniform presentation of the typeface on my website.

If your browser does not support Google Fonts, a standard font from your computer will be used.

The use of Font Awesome is based on Art. 6 para. 1 lit. f DSGVO. I have a legitimate interest in the uniform presentation of the typeface on my website.
